Despite changing the sentence to 50 years of life with the possibility of early release, the California authorities refused to release them.

Erik Menendez first heard the decision – his request for release was rejected after a long, close ten-hour hearing. The Commission and the D.A. indicated that theposes a serious risk to public safety. The problem was, among others, Erik's previous offenses, his behavior in prison, and not taking full responsibility for his actions. Despite support from family and supporters, the decision is clear – Erik may again seek dismissal forThree years.

The day after the Erik decision, Lyle Menendez also heardDenial.The Commission stressed that although Lyle expressed remorse and admitted guilt, features such as manipulation tendencies and liability problems still raise doubts about his willingness to return to freedom.The psychologist estimated the risk of post-release violence to be low, but not enough to allow release now.
