Important message for owners of plots planning to build a house

Land owners and those planning to build a single family house are facing a crucial moment today. Large queues are being created in municipal offices throughout Poland. People are massing their requests for a decision on the building conditions, colloquially referred to as "the set". They want to secure the possibility of making investments before regulations change. This race will last until August 31.

The 2023 spatial planning reform introduces new rules. The municipalities are required to pass general plans that will define the planning zones. After August 31, 2026, decisions on the building conditions will be issued only for the construction areas. In other areas, it may become much more difficult or even impossible to obtain permission to build. For many owners of plots, this means the risk that invested savings, loans and projects will lose value.

So far only a small part of the municipalities – about 11 percent – have passed the general plan. Most of them are still in the process. The deadline for the adoption of the plans was already doubled and was eventually set for 31 August 2026. Applications submitted before that date will be examined on the basis of a study of the circumstances and the principle of good neighbourhood. The date of the application, not the date of the decision, counts.

Differences in the validity of decisions are also important. Applications submitted before 16 October 2025 give an unlimited decision. As of January 1, 2026, the new jacks are valid for 5 years after the finalization. In addition, financial penalties for offices for lengthy proceedings have been abolished since 1 July 2026. That means that things can go on longer, and investors have to look after the formalities themselves.

Experts and officials warn: who plans to build on a plot without a local zoning plan should submit a complete application as soon as possible. It is worth checking the status of the general plan of its municipality and whether the plot will be in the area of building completion. Geoportal.gov.pl and the Bulletin of Public Information of the Municipal Office are helpful. An incomplete request or failure to respond to requests from the Office may delay the case or prevent a decision from being obtained under old rules.

For thousands of families, it's not just a formality, it's real property protection. Savings postponed for years, taken loans and ordered architectural designs are behind these queues. After August 31, 2026, the rules of the game will change to more restrictive. If you make it, you'll have a chance to build a house. If you are late, you may have to wait for a new general plan or resign from your investment.

After 31 August 2026, the provisions concerning the decision on the building conditions will be significantly tightened. The boxes will only be issued for plots located in the so-called construction areas (OUZ) which the municipality will designate in the general plan. Outside these zones, it will become virtually impossible to obtain a decision, even if the plot had previously met the principle of a good neighbourhood. Additional requirement will be full compliance of the planned investment with the general plan (e.g. a planning zone allowing for single-family housing, building parameters, height or construction line). If the municipality does not pass a general plan by that date, the new applications for a note cannot be considered on the basis of the existing rules, which in practice will block investments until the document is adopted.

The principle of a good neighbourhood is one of the basic conditions that must be fulfilled in order to get a decision on the construction conditions (the switch) in the area without a local planning plan.

It follows directly from Article 61(1)(1) of the Spatial Planning and Planning Act. It says that it is only possible to issue a decision to the WZ if at least one adjacent parcel (available from the same public road) is already built in a way that allows to define requirements for new investment.

It's about building a new building. associated to what is already in the area, in terms of:

  • construction parameters and features (height, number of floors, dimensions),
  • architectural form (roof shape, style),
  • construction line,
  • the intensity of land use.

The purpose of this principle is to preserve spatial governance. The new investment is not to be a "foreign body" in the landscape, but to harmoniously fit into the existing nature of the area. However, this does not mean that everything has to be identical – administrative courts stress that certain derogations are allowed, unless this undermines the coherence and harmony of the whole area.

In practice, the office does a so-called urban analysis (a good neighborhood analysis) in which it checks the construction in the immediate surroundings and on this basis determines what parameters your home may have.

By August 31, 2026, this principle is the main basis for issuing pocket money in areas without a local plan. After this date, the principle of a good neighbourhood is no longer enough – there will be an additional, much more restrictive requirement for the location of the plot in the area of building completion set out in the general plan of the municipality.

If you have a lot and you're thinking about home, don't wait. Check the documents, complete the application and submit it to the office in August. This is one of the last moments to work according to the more flexible rules.
