Jarosław Kaczyński lost his trial to Donald Tuski. The court dismissed the lawsuit of "serial female killers"

The District Court in Warsaw on Wednesday, April 15, 2026 dismissed Jarosław Kaczyński's lawsuit against Donald Tusk for protection of personal property. The President of PiS demanded the Prime Minister's public apology and payment of PLN 10 thousand for social purposes.

The case concerned Tusk's statements of June 16, 2023 during a rally at the Freedom Square in Poznań. The leader of the Civic Coalition then said: "Today this power is a serial killer of women." Words came after the death of a 33-year-old pregnant woman in Nowy Targ and were a direct reference to the effects of the tightening of abortion law following the judgment of the Constitutional Court of October 2020.

Judge Tomasz Jaskłowski found that Tusk's statement was within the limits of permitted political criticism and public debate. The court stressed that the wording was not directed personally against Jarosław Kaczyński as a private person, but concerned the responsibility of political power for the legal chaos surrounding abortion.

"Jarosław Kaczyński did not sign the application to the Constitutional Court, but he was a leader, without whom in principle nothing happened in politics. He bears moral responsibility for these tragedies," the judge argued.

As a result, Jarosław Kaczyński was obliged to return PLN 900 to Donald Tusk for the costs of the trial.

Kaczyński's attorney, Adrian Stalus, announced that politicians should have greater responsibility for words, but the court did not share this argument. The Plenipotentiary of Tusk, Mr. Elżbieta Kosińska-Kozak, stressed in turn that the Prime Minister's statement was a voice in a heated public dispute and did not constitute defamation.

The sentence is invalid. The case concerns one of the loudest rhetorical incidents in the Polish politics of recent years and ends with the failure of Jarosław Kaczyński in court.
