Deleted Facebook or X post? From November 6 you can file a complaint with UKE

From November 6, the president of UKE has taken on the role of Digital Services Coordinator, and users in Poland can file complaints against platforms, including Facebook and X, with him. However, not every blocked piece of content means a breach of EU law.

What the law changed

The President signed the act of September 4, 2026 amending the Act on the provision of electronic services and certain other acts. It designates the President of UKE as the national Digital Services Coordinator and entered into force on November 6. That day, UKE posted on X that the office’s president had begun performing the Coordinator’s tasks.

Previously, the role was temporary and based on a resolution of the Council of Ministers. We wrote about the president of UKE’s new powers after the President signed the act.

What you can take to UKE

The basis is the EU Digital Services Act (DSA). It gives a service recipient the right to file a complaint with the Coordinator of the country where they are located. According to UKE, a user in Poland can therefore send a complaint to the president of UKE even when the provider’s main establishment is in another EU country.

The office stresses, however, that a blocked account, a deleted post, or a platform decision we disagree with does not always mean a DSA breach. A complaint concerns an alleged failure by the provider to meet its obligations, e.g. lack of transparency in moderation decisions, insufficient justification for removing content or restricting an account, or lack of effective appeal mechanisms.

Platforms must provide access to an internal complaint-handling system for decisions on their services for at least 6 months from the suspension or restriction of services.

What UKE will not do

The ability to file a complaint does not mean that the president of UKE directly supervises a given provider; jurisdiction rules under the DSA decide that. UKE also indicates that at this stage it will not issue orders to remove or block access to specific illegal content; it called this element a later stage.

In its opinion on the draft, the Polish Ombudsman (RPO) warned that complaints could be used to quickly remove inconvenient opinions and that the office needs adequate staff and financial resources.

Form and council

UKE has prepared a dedicated complaint form available on its official website at https://www.uke.gov.pl/uslugi-cyfrowe-dsa/skarga-do-koordynatora/zloz-skarge and a section with all the necessary information on DSA complaints: https://www.uke.gov.pl/uslugi-cyfrowe-dsa/
