The Upper Norland Appeal Court in Sweden refused to deport 19-year-old Eritrean Yazied Mohamed, convicted of raping a 16-year-old girl. The judges considered that, although the act was serious, it did not constitute "an extremely high-profile crime" which would justify expulsion from the country.
There was a violent attack. September 1, 2024 in a pedestrian tunnel in Skellefteå. 16-year-old Meyer Aberg returned from work at McDonald's and missed her last bus. Then Yazid Mohamed attacked her.
A young man was sentenced to 3 years in prison and obliged to pay the victim about EUR 21 000 compensation and compensation.
Why didn't the court agree to be deported?
Public Prosecutor’s Office She requested the deportation of the convict after serving the sentence. However, the Court of Appeal dismissed this application. In the statement of reasons, the judges pointed to, among others, short duration of rapewho, in their opinion, did not reach the "exceptionally high weight" threshold required by the Swedish right to expel a foreigner.
The decision sparked great outrage in Sweden and beyond. Critics point out that such a ruling demonstrates the serious problems of the Swedish judiciary in matters concerning sexual offences committed by migrants.
Reactions
The case quickly became loud in Swedish media and social media. Many commentators ask directly how can it be violent rape on a minor is not enough reason to be deported.
The victim and her family remain in shock after the court's decision. A 16-year-old woman who fell victim to an attack on her way home must now live with the knowledge that the perpetrator – despite her sentence – is likely to remain in Sweden.
